07-May-2025to 21-May-2025Reporting into the Manager Prosecutions, the Prosecutor 2 will primarily be responsible for the following:
Major Responsibilities:
Screens violation notices and evidence for administrative penalties and makes decisions on them following the City's Administrative Penalty By-Law, other applicable laws, training, guidelines and procedures.Makes notations of screenings/cases/matter dispositions on dockets, or in other relevant computer or document systems and prepares reports.Appears in the Ontario Court of Justice for motions, pre-trial conferences and trials, as necessary.
Argues cases in court:
submits evidence/exhibits, examines/cross-examines witnesses, summarizes evidence, presents oral and written arguments, makes recommendations for judgement/sentence and purges court docketProsecutes charges under the Provincial Offences Act initiated by City Enforcement Divisions, the Toronto Police Service and other enforcement agencies for violations of the Municipal Code, Municipal by-laws, and provincial statutes (e.g., Highway Traffic Act and Compulsory Automobile Insurance ActPrepares relevant documents/correspondence (notices of motion, affidavits, summonses and orders).
Reviews a variety of documents and evidence and prepares and provides disclosureResearches and analyzes case law using legal tools (e.g.
Quicklaw, CanLII, precedent files) to determine appropriate course of action and to assess sufficiency of evidence at trial and make recommendations to City staffConducts early resolution meetings before the Ontario Court of JusticeNegotiates resolutions with opposing counsel, agents and members of the public while ensuring adherence to the departmental and public policyPrepares City staff to appear as witnesses in courtAdvises enforcement staff on prosecution related issuesLiaises with police, lawyers, Judges, Justices of the Peace and court officials to process/resolve filesResponds to inquiries from the public, lawyers, police and City staffMakes notations of case disposition on dockets, prepares reports and ensures appropriate follow-upKey Qualifications:
Your Application must describe your qualifications as they relate to:
Post-secondary education in a Legal Program or a relevant professional discipline or the equivalent combination of education and/or related experience.Considerable experience providing customer service and corresponding with lawyers, police, enforcement staff and members of the public.Experience utilizing a variety of MS Office applications such as Word, Excel and PowerPoint.You must also have:
Excellent interpersonal skills in order to respond to public inquiries both verbally and in writing in an efficient and diplomatic manner.Ability to multitask in a high volume and fast paced environment.Knowledge of the Provincial Offences Act, Municipal By-Laws and other provincial statutes.Knowledge of applicable legal practices and procedures in the Ontario Court of Justice.Knowledge of relevant legislation and public policy.Good understanding of the Administrative Penalty System.Written communication skills to prepare correspondence and legal documentation.Ability to develop and maintain good working relations with members of the Judiciary, legal profession, law enforcement officials and the public.Skills of advocacy; good judgement and analytical skills to assess evidence, determine whether or not to prosecute, and to determine how to proceed with cases in court.Ability to exercise independent judgement and discretion in applying by-laws and policies and the review of Administrative Penalties.A licence from the Law Society of Upper Canada as a lawyer or a paralegal is an asset.Ability to work at any location as needed based on operational needs.Equity, Diversity and InclusionThe City is an equal opportunity employer, dedicated to creating a workplace culture of inclusiveness that reflects the diverse residents that we serve.
